Identity Watch^sm ("IW") is administered by Encore Marketing International, Inc. (the "Administrator").

Membership Term

Upon the expiration of any free trial period, your IW membership is effective for the period covered by your membership fee payment and continues upon your payment of the (monthly/annual) renewal fee automatically charged to the credit card or other billing source authorized by you. Renewal membership fees are billed conveniently and automatically at the then current rate to the credit card or other billing source authorized by you, until you cancel your membership. Should you choose to discontinue your membership for any reason before expiration of the membership term which you have paid for, you may cancel your membership and terminate further billing by calling our toll-free number and receive a refund of your most recently paid membership fee if paid annually. The Administrator reserves the right to change the membership fee for any renewal term to be effective upon the renewal of your membership.

Membership Benefits

Your IW member benefits are intended to help you to manage your personal information wisely to minimize the risk of becoming a victim of identity theft, and to come to your aid should you ever become an identity theft victim (the "Benefits"). Some of these Benefits, which are described below, are made available through third party providers who are independent from the Administrator. Although the Administrator, as the coordinator of all Benefits, has made every attempt to verify the accuracy of information provided, IW, the Administrator, promoter(s) and sponsor(s) make no warranty express or implied including any warranty of merchantability or fitness for a particular purpose, with respect to the Benefits or information provided. You acknowledge that IW, its Administrator, promoter(s) and sponsor(s) are not responsible for identity theft events, cannot guarantee that membership in IW will eliminate the possibility of becoming an identity theft victim and have no liability to you as a seller of any service(s) made available to you through any third party providers. If you do encounter a problem with any service(s), IW will try to assist you in resolving the problem. Cancellation of your membership is understood to be your sole recourse. The Administrator reserves the right to change, alter or amend Benefits at any time and without notice.

Credit Monitoring

IW will enable you to monitor changes to your credit information on file with one or more of the national credit reporting agencies. Neither IW or its contractors can accept responsibility for any derogatory factual information contained in your credit file nor for any inaccuracies in regard to any credit file information provided to you. Such information is obtained by IW on your behalf from the credit reporting agency to be displayed to you upon your request and for your observation only. No warranty is made by IW or its contractors in regard to the accuracy of any information you receive. IW is not a credit repair or credit counseling service in that it does not give advice or assistance to members in improving their credit record. Members are responsible for contacting the credit bureaus on their own to correct perceived inaccuracies in their credit file. In order to activate your credit file monitoring benefit, please complete and return your signed Credit File Monitoring Activation Form.

ID Theft Expense Reimbursement

IW members are eligible for reimbursement for lost wages and other specified costs they incur resulting from an "identity theft", subject to the aggregate limit applicable to the program enrolled in. Actual lost wages up to $500 a week (evidenced by notarized proof from the employer) for time taken off from work to meet with, or talk to law enforcement, government or credit agencies and/or legal counsel, or to complete affidavits, are reimbursable. Other reimbursable costs include costs for notarizing of affidavits or sending of certified mail that certain parties may require of the member as a result of an identity theft, long distance charges incurred in reporting the identity theft, loan application fees for re-applying for a loan originally rejected solely because the lender received inaccurate credit information as a result of an identity theft, and costs for obtaining up to four credit reports from an approved entity as a result of an identity theft. In each case, services arranged for must have the consent or approval of the Administrator. For a full recitation of all terms, conditions and limitations regarding this reimbursement benefit, please contact the Administrator at 1-866-ID FRAUD to request a certificate containing a full recitation of coverage. Members seeking reimbursement for covered lost wages and covered expenses incurred in connection with an identity theft event should contact the Administrator to receive a claim form to submit with supportable documentation. Coverage provided through a nationally recognized insurer.

Toll-Free Legal Helpline, Referral and Consultation

The Legal Helpline is designed to provide information and advice for members on identity theft related legal issues should they become an identity theft victim. Any information or advice provided should not substitute for in-person consultation with an attorney where appropriate, which access can be arranged through the accompanying legal referral plan. Please refer to the member guide for further coverage details. The attorneys who provide information, advice and other representation are solely responsible for the quality of their services, and IW assumes no liability nor makes any warranties with respect to their services. Legal services are administered by Advisory Communications, Inc. In Florida, legal services are offered by LawPhone of Florida Legal Services, Inc. In certain states, legal services may be underwritten by an insurance carrier. Service delivery is supervised by S.H. Dement, Esquire.

Internet Protection Software

Internet protection software in disk (cd) form is provided to you "as is" and we are advised by its publisher is compatible with Windows 95, Windows 98, Windows ME, Windows NT, Windows 2000, and Office 2000. You should consult with the publisher in regard to the compatibility of any other operating systems with the software. You acknowledge that IW, its Administrator, promoter(s) and sponsor(s) cannot warrant or guarantee the content of such software or its performance or the servers to which you may connect to in endeavoring to transfer the software, and are not responsible for your attempted use or usage of the software or any damage caused, in whole or in part, by your utilization of the software, including productivity loss due to usage of the software, computer virus attacks, or the software not working to its advertised potential. You agree that the entire risk arising out of use or performance of the software remains with you. We strongly recommend that, prior to installing or downloading, members read the software installation instructions appearing in the member guide.

Other Benefits

Availability of emergency cash and airline tickets to members stranded away from home without their credit cards due their being lost or stolen conditioned upon verification of available credit on a bank card account. The $1,000 payment reward is made to anyone (excluding member, member's immediate family or law enforcement officers) who provides information leading to the arrest and conviction of a member's Identity Thief.

Use of Membership

Your membership is non-transferable and is limited to you and your spouse. Only you may use your IW membership to obtain the credit monitoring benefit. You and your spouse are eligible to use the remainder of the benefits. Be sure to keep your membership current from year to year because IW and participating providers will not honor a membership card or number that has expired. Please notify us should there be any unauthorized use of your membership card or number.
